2. The contract between us.
- Your use of the Oranges and Lemons Ltd. website (as above) is subject to the following terms and conditions, which may be varied and changed at any time without prior notice. It is your responsibility to ensure compliance.
- This website is provided on an "as is" basis. No warranty, express or implied, or any other claims are made for the factual accuracy of any articles, messages or advertisements placed, or for the merchantability or fitness for purpose of any items advertised.
- We must receive payment for the whole price of the goods before we can accept your order, and before we dispatch any goods.
- Under no circumstances will Oranges and Lemons Ltd., their suppliers or any associated companies be liable for any damages, direct, indirect, incidental, consequential, loss of business/earnings or special damages resulting from the use of this service or any subsequent transactions carried out with any party contacted through this service.
3. Price.
- The prices payable for goods that you order are as set out in our website and are quoted as inclusive of VAT at 20% (at time of writing). The cost of carriage is shown separately and in most cases free UK delivery is included in the price. If for any reason, you are required to pay extra for delivery this will be clearly stated on the website, or in our communication with you.
- Published prices are subject to change without notice. Although every effort is made to ensure the accuracy of pricing information on the website, errors may occur and prices may change. Prices are verified prior to dispatch of items. If the correct price is lower than the price shown on your order, the correct price will be charged. If the correct price is higher than the price shown in your order, we will notify you and either give you the option to cancel the order or to pay the correct price, or else notify you that we are cancelling the order. Errors and Omissions excepted.
4. Payment.
- UK Deliveries – Online we accept payment by Credit or Debit Card via RBS Worldpay. For payments made by credit/debit card we reserve the right to only deliver to the cardholder's registered address. Additionally we can accept payment by cheque (goods will not be sent until payment clears) or BACS – we can supply details as required. Please call us to arrange these alternative payment methods.
- Overseas Deliveries - Payment must be made by Bank Transfer, please call or email for details. Most items available to the UK will not be available to be sent abroad, please call before placing an order if unsure.
5. Sale Procedure and Confirmation.
- On ordering from Oranges and Lemons Ltd. you will be issued a Confirmation of sale to the email address you supply, confirming your order details. This confirmation will also detail our returns policy. Your order is deemed to be an offer to purchase at the price or prices stated in the order. On dispatch of your ordered items, the offer of purchase is deemed to have been accepted by Oranges and Lemons Ltd. for those items.
- A further confirmation will be sent confirming that the good(s) have been dispatched if they are in stock, or to give an estimated despatch and delivery time. If we can only fulfil part of an order immediately, we will contact you to ask whether you want the available item(s) dispatched immediately, or wait until the whole order can be completed in one delivery. If an item becomes unavailable after your purchase we will do our best to fulfil the order or suggest an alternative.
6. Delivery.
- We offer Free UK Mainland Delivery on almost all items ordered online, however a delivery fee may be chargeable on certain fragile items or on particularly heavy items. If a delivery charge is applicable, this will be advertised in the item listing and/or you will be advised of charges before your order is accepted. Delivery to locations outside of UK Mainland is very product dependant, and in most cases is chargeable. Any delivery charges applicable will be notified and agreed with the purchaser, before charges applied and/or products are shipped.
- If you would prefer to "Click-and-Collect" ie. Order online and then collect in the store, please tell us at the time of order and we will happily hold the item in the store for you to collect during opening hours. Please call us to confirm we are open before travelling.
- Items ordered in-store are usually subject to a delivery charge, please ask us for further details prior to purchase
- Delivery will be made as soon as possible after your order is accepted. If your item(s) are in stock, we aim to dispatch (but are not obliged to dispatch) the item the same or next working day on a 24 hour delivery. We do not dispatch on Saturday, Sunday or Wednesday. We may separately dispatch orders of more than one item.
- Goods in transit from us are covered by our carriers insurance and the items will require a signature on delivery.
- We reserve the right to deliver to the billing address or cardholders address only.
- On delivery, the goods will be held at your own risk and you will become owner.
- If an item is obviously damaged in transit (visible from packaging) it is your responsibility to refuse delivery from the courier.
- We shall not be held responsible for delays to delivery from events beyond our control. This includes but is not limited to industrial strikes, extreme weather conditions, accidents and other events that Oranges and Lemons Ltd. has no influence over.
7. Your right to cancel online sales.
- For online sales you may cancel your contract with us any time up to the end of the seventh working day after you receive the goods from us, that is, from the date of proof of delivery from the courier to you. The time periods involved in cancelling are different to those involved in exchanging your purchase. We require written confirmation by post or email that you wish to cancel your purchase within this time period, but you do not need to state a reason and do not have to pay any penalty.
- We then require the item(s) purchased to be returned to Oranges and Lemons Ltd. within ten working days after you receive the goods from us, that is, from the date of proof of delivery from the courier to you. You must take reasonable care of the product while in your possession. The product may be opened to inspect, but not damaged in any way. The packaging must be in a reasonable re-saleable condition when received at Oranges and Lemons Ltd. As the customer you are liable for any postage charges incurred in returning items and we strongly recommend that the delivery is insured against loss or damage as we cannot offer a full refund unless the product arrives and is in undamaged condition. - Exceptions to your right to cancel:
- Audio Recordings - to be returned or exchanged the recording must be returned in an unopened/sealed condition.
- Headphones - to be returned or exchanged headphones must be returned in an unworn/unopened condition for hygiene reasons.
- Cartridges and Styli - to be returned or exchanged any cartridge or styli must be returned in an unused condition due to the nature of the product.
- We will issue refunds for cancelled purchases on receipt and inspection of the item at Oranges and Lemons Ltd. Any refund will be made within 30 days of receipt and must be made to the card that has been used for the initial purchase. Refunds will only be made provided that the goods are returned by you to Oranges and Lemons Ltd. and are received at Oranges and Lemons Ltd. in a reasonable condition as outlined above.
8. Your right to exchange online sales.
- We offer a period where you can exchange your purchase. The time periods involved are different to those for cancelling a purchase as outlined in section 6. We require written confirmation by post or email that you wish to exchange your purchase within ten days (N.B. not ten working days) of receipt of the delivery.
- We then require the item(s) purchased to be returned to Oranges and Lemons Ltd. within fourteen days (N.B. not fourteen working days), that is, from the date of proof of delivery from the courier to you. You must take reasonable care of the product while in your possession. The product may be opened to inspect, but not damaged in any way. The packaging must be in a reasonable re-saleable condition when received at Oranges and Lemons Ltd. The customer is liable for any postage charges incurred in returning items and we strongly recommend that the delivery is insured against loss or damage as we cannot offer a full exchange unless the product arrives and is in undamaged condition. 9. Cancellation of an order by us
- We reserve the right to cancel your order if we have insufficient stock to fulfil the order, if stock is not available or at Oranges and Lemons Ltd. discretion. If an item becomes unavailable after your purchase we will do our best to fulfil the order or suggest an alternative. However if your order is cancelled by us, you will be notified in writing as soon as possible on the email address you supplied and any payment you have made will be refunded as soon as possible and within 30 days of notification of cancellation.
10. Warranty
- If an item is faulty from new and you report a fault within seven working days from the date of proof of delivery from the courier to you. We require the item purchased to be returned to Oranges and Lemons Ltd. for inspection and we ask that you then return the item to us within fourteen working days from the date of proof of delivery from the courier to you. If we can confirm the fault we will contact you to arrange delivery of a replacement item or a refund.
- If an item develops a fault and you report the fault after seven working days from the date of proof of delivery from the courier to you, the item may be covered by warranty. If in warranty the item will be repaired if possible, or otherwise replaced. Please report any fault as soon as possible to avoid missing out on any warranty period. We then require the item purchased to be returned to Oranges and Lemons Ltd. for inspection. The date of the warranty claim will be the date that the item is received at Oranges and Lemons Ltd for inspection.
- All new items are provided with the Full manufacturer’s warranty, which will vary in length and cover. During any warranty period different terms may apply for different manufacturers, some will offer replacements, some will cover repair labour, some will cover repair parts, and some will cover both repair parts and labour. Oranges and Lemons Ltd. offer a minimum 2 year warranty unless otherwise stated; some manufacturers may offer a longer warranty than the standard Oranges and Lemons Ltd. warranty. Some manufacturer’s products will be eligible for warranty extensions with product registration – which is the responsibility of the customer. Vision products will carry a 1 year warranty.
- The customer is responsible for returning the item to Oranges and Lemons Ltd. within warranty, and for any charges not covered by the warranty. Oranges and Lemons Ltd. may make a reasonable charge for any courier charges incurred in returning the item to the manufacturer and/or back to the customer. You may take warranty repairs to any BADA dealer to organise a repair under the manufacturer’s warranty, but you would then be subject to that retailers charges and repair policy.
- All Ex-Demonstration and Used items will have a 3 month warranty unless otherwise stated. The customer is responsible for returning the item to Oranges and Lemons Ltd., and for any charges not covered by the warranty. Oranges and Lemons Ltd. may make a reasonable charge for any courier charges incurred in returning the item to the manufacturer or back to the customer.
- Not all items are possible to repair. Items out of warranty may be able to be serviced by Oranges and Lemons Ltd. as authorised repair agents, or otherwise returned to the manufacturer for repair via Oranges and Lemons Ltd. Out of warranty repairs are chargeable on an agreed basis. Please call us for details of our repair procedure, alternatively a customer may choose to take out of warranty repairs to another company to facilitate the repair. Oranges and Lemons Ltd. reserves the right to refuse to repair or arrange the repair of an out of warranty item.
11. Privacy
- Your name and address and purchase details may be held by Oranges and Lemons Ltd. to aid warranty claims and any future sales. We strictly do not disclose any information to any third parties.
- Temporary cookies are used which provide the shopping cart functionality, and also track your progress through the website. They do not contain data which identifies you personally, and no attempt will be made by us to disseminate any such information. It is only used anonymously to check, for example, popularity of paths through the site etc.
- Data Protection - Financial data in connection with online transactions is not held by us; it is entered directly to a page operated by the payment processing company, RBS Worldpay on their secure web payment page.
